- Can eBay verify my item?
No. eBay has not inspected the item you have listed. Nor do we have enough information about your item to make any judgment as to whether it is authorised. In addition, eBay is not an expert in the rights of any third parties. As a result, we are not in a position to make a judgment as to whether the item you have listed is authorised or legal. This is why we urge you to contact the Rights Owner directly to resolve this matter.
eBay values you as a member of the eBay community, and recognises that on occasion a listing may be ended in error or due to misidentification. To help you better understand why a rights owner might have asked that your listing be removed, we have encouraged rights owners to create their own "About Me" pages. - I want to contact a Rights Owner, what should I do?
When we removed your listing(s) we provided you with the name of the Rights Owner and their contact email address. We do encourage you to contact them where you feel your item was removed incorrectly. Where the Rights Owner has an About Me Page we would encourage you to read this first as this may answer some of the questions you have.
You should ensure you include in your email to the Rights Owner:
- Your eBay user ID
- Your eBay email address
- The listing number(s) that were removed
- Images of your picture where possible
You should wait at least five business days to allow the Rights Owner to get back to you. If you contact the rights owner and do not hear back, or if you have made a good faith effort to resolve the issues with the rights owner but are unable to do so, please contact us and explain your situation. We will make an effort to contact the rights owner to resolve any differences.
If they agree that the listing was ended in error, and the item can be re-listed, please ask them to contact us by email and let us know. Once we receive the email we will allow you to re-list the item.
- Why didn't eBay contact me first?
When eBay is notified by Intellectual Property Rights Owners, of items that infringe their Intellectual Property Rights such as, copyright or trade mark, we are obliged to remove the listings as soon as possible.
- Why are there other listings like mine that have not been removed?
We review all listings that are reported to us by members of eBay and participants in the VeRO (Verified Rights Owners) Programme. These items may not yet have been reported to us or they may not been seen as Infringing by the Rights Owner.
- I bought this item on eBay, why was it not ended then?
We understand the concerns you have expressed as to why this item was not removed before you purchased it on eBay. Unfortunately, there may be times when listings are not removed because the rights owner has not reported them to us.
If you believe an item is potentially infringing, and it was not removed by eBay, then we encourage you to contact the rights owner and inform them of the possible infringement. eBay's Verified Rights Owner (VeRO) Programme works to ensure that items listed do not infringe the copyright, trade marks, or other intellectual property rights of third parties.
- Can I re-list my item without the Rights Owners Permission?
eBay does not and cannot verify that sellers have the right or ability to sell or distribute their listed items. Therefore, we cannot give you permission to re list the item.
If you re list the item without permission from the rights owner, you may risk liability if the rights owner believes that the listing infringes their rights. You also run the risk of your eBay account being suspended.
